3.  DESCRIPTION OF THE SERVICE

a . Editorial content and the proposal of tourism products and services

On the Website, the CRDTA proposes tourist information about the Auvergne, with the goal of helping users to prepare their stay or holiday in the region.

The users of the Website consequently have access to information displayed in a themed manner enabling them to discover the Auvergne as a tourist destination, but also to practical information helping them to organise their stay.

A search engine is provided for users, enabling them to access lists of service providers in addition to various documents and videos to help them make a success of their stay in the Auvergne. Concerning the presentation and marketing of the proposed stays, the CRDTA operates exclusively as an intermediary in the relationship between the users and service providers. This intermediary role is performed free of charge by the CRDTA with the aim of supplying information to the client. Despite all of the care and attention it devotes to these proposals, the CRDTA may under no circumstances be considered liable for any failings on the part of the service provider vis-à-vis its obligations to the client.

b. Online bookings

The Website provides access to tourism products incorporated within the regional e-marketplace system (Tool used: Open system from Alliance Réseau) in order to enable users to directly access the producers’ availability data and online reservation features. Each producer’s general terms are accessible at the time the reservation is to be confirmed. You must accept the general terms prior to making a reservation.

 

4.  ACCESS AND AVAILABILITY

Access to the CRDTA's Website is available to any person wishing to obtain information concerning tourism activities in the Auvergne.

Access to the Website is provided in a continuous and permanent manner except in cases of force majeure or events outside the CRDTA's control, and subject to any possible breakdowns or maintenance work required to ensure the satisfactory operation of the Website.

Furthermore, due to the inherent nature of the Internet, the CRDTA is unable to guarantee that the Website will be operational 24-hours a day, 7 days a week.

The role of the CRDTA is not that of a sales company.
The CRDTA simply hosts the content of the advertisements placed online by the professionals (including text and photos) either directly or via local reservation centres, in addition to orders from their clients.

The CRDTA is in no way involved in transactions between the purchaser and vendor.

Thus, the CRDTA provides no guarantees concerning the advertisements placed online, particularly concerning the capacity of the vendors, the accuracy of their advertisements, or the quality of the products and services proposed.

Similarly, the CRDTA issues no guarantees concerning the purchasers, and particularly regarding their capacity to pay for the goods or services ordered by them.

The new clauses will govern all future dealings between the parties and only the new version will be considered valid among them.

The present General Terms of Use are governed by French law concerning both their content and form.

In the event of any disputes or litigation, the parties agree to seek an out-of-court solution before referring the matter to the competent jurisdiction.
